Welcome to Essentyx. Essentyx is an AI-powered text-neutralization service that helps you read web content with less rhetorical bias and emotional framing. These Terms of Service ("Terms") govern your use of the Service.

Essentyx is a product operated by Mindwave IT Services - FZCO. Essentyx itself is not a separate legal entity. Throughout these Terms, "Essentyx", "we", "us" and "our" refer to Mindwave IT Services - FZCO acting in connection with the Essentyx product.

The Service includes our browser extension, web dashboard and related features accessible at https://essentyx.com and associated domains.

By accessing or using Essentyx, you agree to be bound by these Terms. If you do not agree, do not use the Service.

About this AI tool. Essentyx is an AI-powered text-neutralization service. Outputs may contain errors and are not legal, financial or medical advice. You are responsible for reviewing neutralized text before relying on it. See Warranty Disclaimers and Limitation of Liability below.

We may update these Terms from time to time. If we make material changes, we will provide you with additional notice, such as by sending you an email.

How Essentyx Works

Essentyx helps users identify and reduce rhetorical bias in text, including emotional language, charged verbs, hyperbole, presuppositions, vague quantifiers, metaphors and ideological framing, while preserving factual content such as names, dates and statistics. The Service processes text using third-party large language models accessed via OpenRouter. Essentyx does not guarantee perfect neutrality or factual accuracy; outputs are AI-generated suggestions intended to assist human judgment, not replace it.

Account Registration and Eligibility

• You must be at least 16 years old to use Essentyx. If you reside in the United States, you must be at least 13 years old. If local law requires a higher minimum age in your jurisdiction, you must meet that requirement.
• Accounts are for individual use only. We do not offer team, business, education, or organizational plans at this time.
• You may register using Google OAuth. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

Free and Paid Subscriptions

Free Trial

New users receive a 14-day trial with 2,000 neutralization requests per month and no analytics features. Only one trial period is permitted per user. Trial access terminates immediately upon cancellation.

Essential Plan

Paid subscription offering 5,000 neutralization requests per month. No analytics features included.

Pro Plan

Paid subscription offering 15,000 neutralization requests per month and full analytics features, including clarity scores, trigger-type breakdowns and dashboard visualizations.

Billing

• Subscriptions are billed monthly or annually via Stripe Checkout.
• You are responsible for all applicable taxes. We will charge tax where legally required.
• You may cancel or modify your subscription anytime through the Stripe Customer Portal. Cancellation takes effect at the end of your current billing period; no partial refunds are provided for unused time within a billing cycle.
• Refunds are issued only where required by applicable law.
• We reserve the right to suspend accounts with overdue payments or downgrade them to the free tier.

Price Changes

We may update subscription fees with at least 30 days' advance notice via email. Changes apply to your next billing cycle.

Your Content and Our Data Practices

User Content refers to text you submit to Essentyx for neutralization.

• You own your User Content. Essentyx does not claim ownership of any text you submit.
• No storage of original text: Your submitted text is processed in-memory and is never persisted to our servers after neutralization completes.
• Limited metadata storage (Pro users only): If you use the Pro plan with analytics enabled, we store only non-identifying metadata: trigger counts, trigger categories (not the original text), clarity scores and character counts. This metadata is associated with your account but does not contain your original content.
• No training on your content: Essentyx does not use your submissions to train or improve any AI models. Text is transmitted to OpenRouter solely for inference purposes. OpenRouter's data policies apply to that transmission step; we do not control or assume responsibility for third-party provider practices.
• Your responsibilities: You are solely responsible for the legality and appropriateness of text you submit. Do not submit content that violates laws, infringes third-party rights, or contains sensitive personal data you are not authorized to process.

Data Rights

You may:

• Export your account data (including stored metadata) via /account/export
• Request complete account deletion, which removes all associated metadata and anonymizes your account per GDPR requirements

License to Our Service

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Essentyx solely for your personal, non-commercial purposes, provided you comply with these Terms.

All rights, title and interest in Essentyx, including software, algorithms, trademarks and user interface design, remain our exclusive property and are protected by copyright, trademark and other intellectual property laws. Except as expressly permitted herein, you may not copy, reverse engineer, decompile, or create derivative works of the Service.

We welcome feedback. By providing feedback, you grant us a royalty-free license to use it without restriction or obligation to you.

AI Outputs and Prohibited Uses

AI Outputs Are Not Guaranteed

• Neutralized text is generated by AI and may contain errors, omissions, or imperfect rewrites. Do not rely on outputs as factually authoritative or legally/financially binding.
• Due to the nature of machine learning, similar inputs may produce different outputs and identical outputs may be generated for different users.
• You are solely responsible for reviewing and validating all neutralized text before use.

Prohibited Uses

You may not use Essentyx to:

• Process text containing highly sensitive personal data (e.g., health records, financial account details) without appropriate legal basis
• Generate content that is illegal, defamatory, harassing, or infringes third-party rights
• Reverse engineer, extract, or misuse outputs to train competing AI models
• Misrepresent AI-generated neutralizations as human-written without disclosure where ethically or legally required
• Automate abuse (e.g., excessive request volumes beyond plan limits)
• Upload malware, malicious code or content designed to exploit, disrupt or circumvent the Service or its infrastructure
• Interfere with another user's use of the Service, including by overwhelming shared infrastructure or attempting unauthorized access to another account
• Impersonate any person or entity, or misrepresent your identity or affiliation, including by spoofing headers or providing false account information

Third-Party Services

Essentyx uses OpenRouter to access large language models for text processing. Your submissions are transmitted to OpenRouter solely to perform neutralization. We are not responsible for OpenRouter's practices and you acknowledge that OpenRouter's terms and privacy policies apply to that transmission step.

Indemnification

You agree to indemnify, defend and hold harmless Mindwave IT Services - FZCO, its affiliates, officers, employees and agents from and against any third-party claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service in breach of these Terms or any applicable law
• Content you submit to Essentyx that infringes the intellectual property, privacy or other rights of any third party
• Your misrepresentation of AI-generated outputs as human-written where disclosure was required
• Your violation of any third party's rights through your use of the Service

We reserve the right to assume the exclusive defense and control of any matter for which you are required to indemnify us, in which case you agree to cooperate with our defense.

Copyright Complaints

If you believe that material made available through Essentyx infringes your copyright, you may send a notice that complies with the U.S. Digital Millennium Copyright Act (DMCA) or the equivalent provisions of your local law. The notice should include:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material claimed to be infringing, with enough detail for us to locate it
• Your contact information (address, phone number, email)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

Send notices to essentyx@gmail.com with the subject line "Copyright Complaint." We will respond to valid notices in accordance with applicable law and may remove or disable access to the material in question.

Submitting a false claim of infringement may expose you to liability for damages, including costs and legal fees, under DMCA Section 512(f) or analogous law.

Termination

We may suspend or terminate your access if:

• You breach these Terms, including the Prohibited Uses listed above
• Your use poses security risks or harms other users
• You maintain an inactive free account for 12+ consecutive months

Before termination for non-material breaches, we will provide reasonable notice via email and an opportunity to remedy the issue. Upon termination, you may export any stored metadata before account deletion.

Sections addressing liability, warranties, intellectual property and dispute resolution survive termination.

Warranty Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESSENTYX AND MINDWAVE IT SERVICES - FZCO PROVIDE THE SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY OF AI OUTPUTS.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE
• NEUTRALIZED TEXT WILL BE FACTUALLY ACCURATE OR COMPLETELY BIAS-FREE
• ALL BIAS TYPES WILL BE DETECTED OR CORRECTED
• THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS

YOUR USE OF ESSENTYX IS AT YOUR SOLE RISK.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MINDWAVE IT SERVICES - FZCO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION
• DAMAGES ARISING FROM USE OR INABILITY TO USE THE SERVICE
• ERRORS OR OMISSIONS IN AI-GENERATED OUTPUTS

OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU USE THE FREE TIER, OUR MAXIMUM LIABILITY IS $50 USD.

SOME JURISDICTIONS DO NOT ALLOW LIABILITY LIMITATIONS; THESE MAY NOT APPLY TO YOU.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of laws principles. This choice of law does not deprive you of the protection of any mandatory consumer-protection rules of the law of the country where you have your habitual residence.

Informal Resolution

Before initiating formal proceedings, you must first send a written notice to us at essentyx@gmail.com describing the dispute and the relief you are seeking. We will attempt to resolve the dispute in good faith. If we cannot reach a resolution within 30 days after the notice is received, either party may proceed with formal dispute resolution as described below.

Class Action Waiver

To the maximum extent permitted by applicable law, you and Essentyx agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service will be brought only in your individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding. The parties may not consolidate the claims of more than one person. This waiver applies whether the dispute is resolved in arbitration, in court or in any other forum, except where prohibited by applicable law.

Arbitration (for U.S. Residents)

If you reside in the United States, disputes arising from these Terms will be resolved by binding arbitration under the American Arbitration Association's Consumer Rules, except claims eligible for small claims court. Arbitration will occur in Dubai, UAE. Consistent with the Class Action Waiver above, you waive the right to participate in class actions or class arbitrations.

General Jurisdiction

For users outside the U.S., you consent to the exclusive jurisdiction of the courts of Dubai, UAE, for resolving disputes, except where mandatory local consumer protection laws provide otherwise. Without limitation, consumers resident in the European Union, the European Economic Area, the United Kingdom or Switzerland may bring claims in the courts of their country of residence, and nothing in these Terms limits any non-waivable rights you have under your local consumer protection law.

Notices and Electronic Communications

You agree that we may provide you with required notices, agreements and other information concerning the Service electronically, including by email sent to the address on your account, by posting on essentyx.com or through the Service itself. You are responsible for keeping your account email current. A notice sent by email is deemed received on the date it is sent.

To send a formal notice to us, write to essentyx@gmail.com. A notice to us is deemed received on the next business day after we acknowledge it.

Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, acts of war or terrorism, civil disturbances, government actions, labor disputes, internet or telecommunications failures, outages of third-party service providers (including hosting, payment and AI inference providers) and similar events. Performance is excused for the duration of the force majeure event and a reasonable time thereafter.

Modifications to These Terms

We may update these Terms periodically. Material changes that significantly affect your rights will be communicated via email at least 30 days before taking effect. Continued use after updates constitutes acceptance. Non-material changes (e.g., contact details, feature names) take effect upon posting.

If you disagree with updates, cancel your subscription before the effective date.

General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and us regarding Essentyx.
• Severability: If any provision is unenforceable, the remainder remains valid.
• Assignment: You may not assign your rights. We may assign ours to affiliates or successors.
• Waiver: Our failure to enforce a provision is not a waiver of future enforcement.
